The term ‘Waypoint Books’ or ‘us’ or ‘we’ refers to the owner of the website. The term ‘you’ refers to the user or viewer of our website.
We may revise these Terms from time to time in the following circumstances:
- changes in relevant laws and regulatory requirements; or
- as we consider to be necessary in light of current trading and/or the general business environment, whether locally, nationally or internationally.
Whenever we revise these Terms, we will give you notice of this by changing the relevant date at the top of this page.
These Terms are governed by English law. This means a Contract for the purchase of Products through our site and any dispute or claim arising out of or in connection with it will be governed by English law. You and we both agree that the courts of England will have non-exclusive jurisdiction to resolve any dispute between us.
Intellectual Property Rights
We are the owner of all intellectual property rights in our site, including any brand names, service names and trademarks (whether registered or unregistered) and in the material published on it. Those works are protected by intellectual property laws and treaties around the world. All such rights are reserved.
You must not modify or use any illustrations, photographs, video or audio sequences or any graphics without express permission. Our status (and that of any identified contributors) as the authors of content on our site must always be acknowledged.
Nothing in these terms excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law. To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our site or any content on it, whether express or implied.
We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:
- use of, or inability to use, our site; or
- use of or reliance on any content displayed on our site.
Please note that we only provide our site for domestic and private use. You agree not to use our site for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programmes, data or other proprietary material due to your use of our site or to your downloading of any content on it, or on any website linked to it.
We assume no responsibility for the content of websites linked on our site. Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them.
We will not be liable or responsible for any failure to perform or delay in performance of, any of our obligations under a Contract that is caused by an Event Outside Our Control. An Event Outside Our Control means any act or event beyond our reasonable control, including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or another natural disaster, or failure of public or private telecommunications networks or impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
Every time you order Products from us, the Terms in force at that time will apply to the Contract between you and us.
The images of the Products on our site are for illustrative purposes only and the Products may therefore vary slightly from those images. The packaging of the Products may vary from that shown in images on our site.
All Products shown on our site are subject to availability. We will inform you by e-mail as soon as possible if the Product you have ordered is not available and we will not process your order.
If we are unable to supply you with a Product you have ordered, for example, because that Product is not in stock or no longer available or because of an error in the price on our site, we will inform you of this by e-mail and we will not process your order. If you have already paid for the Products, we will refund you the full amount of the order price as soon as possible.
Cancellation and Returns
You have the right to cancel an order up to thirty days after the order has been processed. This means that during the relevant period if you change your mind or for any other reason you decide you do not want to keep a Product, you can notify us of your decision to cancel the order and receive a refund. If you cancel your order, we will try to stop it before the Product is dispatched to you but please be aware that this may not always be possible. Where we are unable to stop your Product from being dispatched please return it to us when you receive it, at which point we will process your refund in accordance with these Terms.
It is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired, and the Product should be returned to the address provided below within 15 days. Your refund shall be granted once the Product has been returned. Please note we are permitted by law to reduce your refund to reflect any reduction in the value of the Products, if this has been caused by your handling of them other than what is necessary to establish the nature, characteristics and functioning of the Products. If we have inadvertently been charged for the direct cost of returning the Product to us (e.g. where you have elected to ‘return to sender’), unless the Product is faulty or not as described we will deduct such direct cost from the refund you would otherwise have been entitled to.
To cancel an order, please email me at email@example.com with ‘Cancellation: Product Name’ in the subject box. We will refund you on the credit card or debit card used by you to pay. If you used vouchers to pay for the Product we may refund you in vouchers.
You may wish to keep a copy of your cancellation notification for your own records. Unless the Product is faulty or not as described you will be responsible for the direct cost of returning the Product to us. We will refund the price you paid for the Products.
